Terms of Use

1. Overview

These terms apply to all tools at tools.datahit.co ("the Tools"), provided by DATA HIT Ltd ("DATA HIT", "we"), a company registered in England and Wales with registered address at 2 Infirmary Street, Leeds, LS1 2JP. The Tools currently include the Seasonal Spiral, Timing Grid, SERP Seasonality Map, and the Seasonal Spiral community visualisation for Data Studio.

By using any of the Tools, you agree to these terms.

2. Licence

DATA HIT grants you a non-exclusive, non-transferable, perpetual licence to use the Tools for your own analytics and research purposes (personal or within your organisation). You may share share-link URLs we generate. You may not redistribute, resell, sublicense, or proxy the Tools' API endpoints to third parties.

3. Free-tier fair use and rate limits

The Tools are offered free of charge with the following per-IP rate limits applied at our edge to prevent abuse and contain operating costs:

• SERP scans — 10 requests per minute per IP.
• Share-link creation — 30 requests per minute per IP.

Requests exceeding these limits will receive an HTTP 429 response with a Retry-After header. Sustained, automated, or commercial-scale querying intended to circumvent these limits is not permitted. Repeated violations may result in temporary or permanent blocking of IPs or networks.

4. Third-party data sources and accuracy

The SERP Seasonality Map ingests data from third-party providers:

• DataForSEO — supplies the public Google search-results history, Google Ads search-volume data, and AI-search-volume data displayed in the tool. DataForSEO's data may be incomplete (e.g. fewer than 12 months of history for niche keywords), lagged behind real time (typically by approximately one month), or subject to their own terms and accuracy disclaimers.
• Anthropic — supplies the "What this reveals" insight via the Claude family of large-language models. As with all LLM-generated content, the insight may occasionally contain mistakes, misattributions, or hallucinations. Do not rely on the insight as the sole basis for any commercial decision. Treat it as an analyst's first-pass observation and verify against the data itself.

DATA HIT has no control over and accepts no responsibility for the accuracy, completeness, or freshness of third-party data displayed in the Tools.

5. Acceptable use

You may not use the Tools to:

• Submit keywords that reveal a third party's personal information (PII), medical conditions, or other sensitive data — these would be transmitted to our third-party processors and may appear in their logs;
• Generate content that violates Anthropic's Acceptable Use Policy or DataForSEO's terms of service;
• Republish or resell the cached scan data, derived insights, or share-link URLs as a paid product without DATA HIT's written consent;
• Attempt to exhaust, probe, or reverse-engineer the rate limits, caching layer, share-link slug space, or any other infrastructure;
• Use the Tools to perform any activity that is illegal under UK law.

6. Share links

Share-link URLs (e.g. tools.datahit.co/s/ab3k7p2x) we generate resolve to the cached scan for a given keyword + country pair, retained for 30 days from slug creation. Anyone in possession of the URL can view the cached result. Slugs are random and unguessable but are not a security boundary — do not use them to share sensitive keywords.

7. Availability and support

The Tools depend on Cloudflare Workers, DataForSEO, Anthropic, and Google's OAuth / Data Studio infrastructure. DATA HIT is not responsible for outages, schema changes, or discontinuation of any underlying service. We provide best-effort availability with no contractual SLA on the free tier. 8. Limitation of liability

The Tools are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, DATA HIT is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity arising from your use of (or inability to use) the Tools — including any reliance on third-party data displayed within them.

9. Changes to these terms

DATA HIT may update these terms. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Tools constitutes acceptance of any changes.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the Tools shall be subject to the exclusive jurisdiction of the courts of England and Wales.
